Transparency

The new regulatory framework on transparency is the result of Legislative Decree No. 97 of May 25, 2016, titled “Revision and simplification of provisions on the prevention of corruption, publicity, and transparency.”

The main innovations concern the application of transparency measures to publicly owned companies, limited to data and documents related to activities of public interest governed by national or European Union law.

The Atena Future Technologies District is a company with shareholding from public administrations, including: the University of Naples “Parthenope,” the University of Genoa, the University of Perugia, the University of Pisa, the University of Salerno, the University of Sannio, ENEA, and CRDC. The total shareholding held by public administrations is below 50%, with each administration holding less than 5%. Therefore, Atena does not meet the criteria to be classified as a “publicly controlled” company.

Moreover, there are no contractual relationships between Atena and its shareholders whose establishment or continuation constitutes a condition for the existence and survival of the company’s business capacity pursuant to Article 2359, paragraph 1, no. 3) of the Italian Civil Code.

Transparency includes both the publication on websites of data and documents subject to mandatory disclosure, and the exercise of the right to general civic access. The latter concerns data and documents that are not subject to mandatory publication and also applies to private entities such as ATENA, but only with regard to data and documents related to activities of public interest.

Therefore, in compliance with the aforementioned obligations, information related to transparency is made public and accessible. This data is regularly updated, easy to consult, and consistent with the original documents held by the administration.
